Hi do I really need this piece of annoying rubber that keeps hindering my up and down motion and what do you put in its place and what is it even for haha

As you are missing at least one push rivet in the photo (left hand side) I'd guess someone had it apart. Logic says the rubber part didn't get tucked in, and it's likely there as a waterproofing shield behind the vents.
Exactly, that protects the raise/lower mechanism from water. You will need to remove the cowl pieces and tuck that inside. Since there are moving parts in there, its best to do it right the first time. It's been a while since I read this, but I'd expect you will find mention of it in this article:
It's not that hard to reposition properly. I think you can do it without removing the windshield from its mounts. Raise the windshield to the highest position. then remove those eight retaining pins and lift it away from the upper cowl. then tuck the rubber sheet inside, making it as flat as you can. Then position the windscreen inner cowl (the part in question) and replace the plastic retainers.
